These Terms & Conditions (“Terms”) govern your use of the Digital Music Forge website and Services. By accessing or purchasing from our Site, you agree to these Terms.
1. Use of Services
- You must be at least 18 years old to purchase.
- You agree not to misuse the Services or submit unlawful content.
- We reserve the right to refuse service, terminate accounts, or cancel orders at our discretion.
2. Intellectual Property
- All custom songs created by Digital Music Forge are original works.
- Upon purchase, you receive a personal, non-exclusive, non-transferable license to download and use the song.
- You may not resell, redistribute, or commercially exploit the music without express written consent.
3. Creative Submissions
- By submitting lyrics or other content, you represent that you own or have rights to the material.
- You grant Digital Music Forge a limited license to use your submissions solely for the purpose of creating your custom music.
- You remain the owner of your original submissions.
4. DMCA Safe Harbor (Copyright Complaints)
Digital Music Forge respects intellectual property rights. If you believe content on our Services infringes your copyright, please send a written notice to info@digitalmusicforge.com with:
- Identification of the copyrighted work claimed to be infringed.
- Identification of the material that is claimed to be infringing.
- Contact information for the complaining party.
- A statement of good faith belief that the use is not authorized by the copyright owner.
- A statement, under penalty of perjury, that the information is accurate and you are authorized to act on behalf of the copyright owner.
We will respond in accordance with the Digital Millennium Copyright Act (DMCA).
5. Payments & Refunds
- All payments are processed securely through third-party processors.
- Due to the personalized nature of our products, all sales are final and non-refundable, except where required by law.
6. Limitation of Liability
- To the fullest extent permitted by law, Digital Music Forge disclaims all liability for damages arising from use of our Services.
- Our liability shall not exceed the amount you paid for the Services.
7. Indemnification
You agree to indemnify and hold harmless Digital Music Forge, its owners, employees, and affiliates against any claims, damages, or expenses arising out of your use of the Services or breach of these Terms.
8. Governing Law & Jurisdiction
These Terms shall be governed by and construed under the laws of the State of Texas, without regard to conflict of law principles. Any disputes shall be resolved exclusively in the state or federal courts located in Johnson County, Texas.
9. Termination
We may suspend or terminate your access to our Services for violation of these Terms or unlawful activity.
10. Entire Agreement
These Terms, together with our Privacy Policy, constitute the entire agreement between you and Digital Music Forge.
